Poland – FSA Krzysztof Gawla Substantial Shareholding Penalties

On 30 January 2024, POL FSA upheld decision of POL FSA to impose the fines of 20,000 PLN, 140,000 PLN, 220,000 PLN, 40,000 PLN, 110,000 PLN, 200,000 PLN, 140k PLN.

Background

On July 2023, POL FSA fined Krzysztof Gawla for various violations related to not notifying certain companies and the Commission about changes in substantial shareholding.

Penalties

  • On 16 June 2023, a fine was imposed of 20k PLN for not informing Budopol-Wroclaw SA and the Commission about a decrease in their voting rights below 5%.
  • POL FSA also imposed a fine of 140,000 PLN for not notifying various instances of increasing and decreasing substantial shareholdings in Elkop SA and Elkop SE on specific dates.
  • A fine of 220,000 PLN for not informing Investment Friends SA and Investment Friends SE about increasing their shareholdings above specific thresholds on certain dates.
  • Also, a fine of 40k PLN for not notifying AllIn! Games SA about increasing and decreasing their substantial shareholding on specific date, and fine of 110k PLN for not informing M-Trans SA about increasing and decreasing their substantial shareholding on specific dates.
  • A fine of 200k PLN for not notifying Magna Polonia SA about increasing and decreasing their substantial shareholding on specific dates as well as not reporting substantial shareholding changes.
  • In addition, a fine of 140,000 PLN has been imposed by POL FSA for not notifying Present24 SA about increasing and decreasing their substantial shareholding on specific dates.
