E.U. – ESMA Increased EU Data Use Reported Re: Short Selling

On 30 April 2025, ESMA issued new report on ensuring better data quality.

  • ESMA published the fifth edition Report on the Quality and Use of Data, revealing how regulatory data collected had been used by EU authorities, providing insight on actions.
  • Follows ESMA May 2024 issued report on regulatory data quality.

Report Overview

  • The document presents a variety of concrete cases on data use, ranging from market monitoring to supervision, as well as on enforcement and on its use in policy making.
  • A recent examples include how ESMA re-utilized data to support a reporting reduction by using previous MIFIR transaction data, in transparency and volume cap calculation.
  • The report highlights ESMA's Data Platform and various ongoing improvements to data quality frameworks as the key advancements in tools and technology for data quality.
  • In addition, it contains other advances like data quality developments for datasets as EMIR REFIT go-live, successful outcome of newly implemented data quality framework on short selling data, and first steps in improving NCA access to and use of ESEF data.
  • Edition also gives an overview of penalties imposed by NCAs on reporting obligations (short selling), showcasing another tool that used as part of their supervisory and enforcement toolkit.
